Osun State Governor Ademola Adeleke has filed a 2 billion naira suit against the EFCC over the freezing of the state’s Federal Statutory Allocation Account.
The suit, filed at the Federal High Court in Abuja, names the EFCC, its chairman, and First Bank Nigeria as defendants.
Adeleke’s lawyers argue the account freeze was carried out without a valid court order, describing it as unconstitutional and a violation of due process.
The plaintiffs are seeking an order to unfreeze the account and a perpetual injunction restraining further interference without due process.
The EFCC had earlier confirmed freezing the account, saying it was investigating alleged fraudulent handling of about N11 billion in Ecology, Intervention and FAAC funds since March.
President Bola Tinubu has since directed the EFCC to vacate the freeze, saying he was embarrassed by the timing of the agency’s action.
